Privacy Notice

The short version

Lowen's Tides runs on WhatsApp. To join the waitlist we ask for one thing: your phone number — and we only have it because you messaged us first.

1. Who we are

Brewyon & Co Ltd is the data controller for the personal data described in this notice. That means we decide why and how it is used, and we are responsible for it.

We have not appointed a Data Protection Officer, and we are not required to: none of the conditions in Article 37(1) UK GDPR applies to us. Joshua Marsh is our point of contact for anything in this notice.

2. What we collect, and why

2.1 The waitlist — before we launch

You give consent by replying YES. Nothing is sent to you before that. Providing your number is entirely voluntary — there is no contract or legal requirement to give it, and the only consequence of not giving it is that we cannot tell you when we open. You can withdraw at any time by replying STOP, exactly as easily as you gave it.

We never see or store your card details. Payment is handled entirely by Stripe.

If you buy a gift year for someone else: Stripe processes your payment and holds your email, as above; we hold only the gift code you're given, the reference for the payment that bought it, and once it is redeemed, the recipient's subscription. We learn nothing about the recipient until they message Lowen themselves, and nothing about you beyond the purchase. We never ask you for your name, date of birth or home address. We do not need them.

2.3 If you opt out

When you reply STOP we delete your waitlist entry, but we keep one thing: a scrambled one-way marker derived from your number, with the date. That is how we know never to contact you again. We are required to honour an opt-out, and we cannot do that with no record of who opted out. It holds no number, no message content and nothing else, and we keep it indefinitely. This is permitted by Article 17(3)(b) UK GDPR.

3. How your phone number is protected — and an honest word about "anonymous"

Your number is the only identifying thing we hold, so we treat it accordingly:

We want to be straight with you about what that second point does and doesn't mean. The scrambled version is not anonymous. We hold the key, so we can always work back to you — which means UK law treats it as your personal data just like the number itself, and so do we. It is a security measure, not a way of putting your data outside your control. All your rights below apply to it in full.

4. Who else is involved

We use a small number of service providers. They process data on our instructions under written contracts meeting Article 28 UK GDPR, except where noted.

Transfers outside the UK. Where a provider processes data outside the UK we rely on UK adequacy regulations where they apply (including the UK Extension to the EU–US Data Privacy Framework), and otherwise on the International Data Transfer Addendum to the EU Standard Contractual Clauses, with a transfer risk assessment on file. You can ask us for a copy of the safeguards in place.

We will also disclose data where we are legally required to — a court order, or a lawful request from a regulator or the police.

6. Your rights

Under UK GDPR you have the right to:

The quickest way to exercise most of these is to reply STOP in WhatsApp — that deletes your waitlist entry immediately. For anything else, email josh@brewyon.com. We respond within one month, free of charge. If your request is complex we may extend that by up to two further months, and we will tell you if so.

7. How to complain

Complain to us first, if you're willing — we would rather fix it. Email josh@brewyon.com with "Data protection complaint" in the subject line, or reply to Lowen on WhatsApp with the word COMPLAINT and we will pick it up. You don't need to use any particular form of words.

We will acknowledge your complaint within 30 days and respond as quickly as we can after that.

You can also complain to the regulator at any time, whether or not you come to us first. The Information Commissioner's Office: ico.org.uk/make-a-complaint, or 0303 123 1113, or Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF.

8. Children

Lowen's Tides is not intended for children under 16, and we do not knowingly collect their data. If you believe a child has joined the waitlist, email us and we will delete the entry.

9. The website

Our website sets no cookies and uses no analytics or tracking. Fonts, images and everything else are served from our own domain, so loading a page contacts no third party at all.

10. Changes to this notice

If we change anything material we will update the version number at the top and, where the change affects what you consented to, ask you again. Previous versions are available on request.

11. Safety, and what this service is not

Lowen's Tides is for general information. Conditions at sea change fast, our data comes from third parties and can be wrong, delayed or missing, and it must not be used for navigation or relied on for safety. Always check official sources and use your own judgement. In an emergency at sea, call 999 and ask for the Coastguard.
