Terms of Use

These terms govern your use of Lowen's Tides. They apply together with our Privacy Notice, which explains how we handle your personal data. By joining the waitlist, starting a trial or taking out a subscription, you accept these terms.

The service provides coastal information for general guidance only and must not be relied on for navigation or safety; you may cancel at any time, and a first payment is refundable in full within 14 days; nothing in these terms affects your statutory consumer rights.

1. Who we are

Lowen's Tides is operated by Brewyon & Co Ltd, a company registered in England and Wales, company number 17343425, with its registered office at 66 Paul Street, London EC2A 4NA. Contact: josh@brewyon.com.

2. The service — and its limits

Lowen's Tides provides United Kingdom coastal information — tide predictions, weather, sea temperature, sun times, bathing-water classifications and sewage-spill reports — delivered over WhatsApp and through a companion web page. The information is drawn from third-party sources, including the UK Hydrographic Office, Open-Meteo and the Environment Agency. We select reputable sources, but we cannot guarantee that the information is complete, current or accurate.

The service is provided for general information only. It is not a navigation or safety product, and it must not be relied upon for any decision that affects your safety on or near the water.

Conditions at sea change quickly and can differ materially from any forecast or prediction. Always consult official sources and exercise your own judgement. In an emergency at sea, call 999 and ask for the Coastguard.

You must be at least 16 years old to use the service.

3. The waitlist

Joining the waitlist is free and creates no obligation on either side. The data we hold about waitlist members, and how to leave the waitlist, are set out in the Privacy Notice.

4. Your access

Your phone number identifies your account. Your personal web page is reached by a private link: keep it confidential, as anyone who holds it can view your saved locations. Use of the service must be personal and non-commercial, and is subject to fair use — currently up to 20 lookups per day. You must not use automated tools against the service, interfere with its operation, resell it, or systematically extract or redistribute the data it contains. Tide predictions in particular are Crown copyright material licensed to us for the operation of this service, and may not be supplied onward.

5. Subscriptions, trials and prices

Paid plans and their prices are shown at the point of purchase. Payment is processed by Stripe; we do not receive or store your card details. Unless stated otherwise at purchase: monthly plans renew each month, and you may cancel at any time with access continuing to the end of the paid period; annual plans renew each year. New users receive a 14-day free trial, without payment details, limited to one trial per person. Founder-rate pricing remains fixed for as long as that subscription remains active. We may change prices for future billing periods on at least 30 days' notice; price changes never apply to a period already paid for, or to an active founder-rate subscription.

6. Cancellation and refunds

You may cancel at any time, using the link on your page or by contacting us. If you cancel within 14 days of your first payment, we will refund that payment in full. After that period, monthly payments are not refunded and access continues to the end of the paid period; annual payments are not refunded in part. If we materially reduce the service during a period you have paid for, you may contact us and we will consider a fair partial refund. Nothing in these terms affects your statutory rights, including under the Consumer Rights Act 2015.

7. Gifts and referrals

A gift purchase provides a single-use code granting twelve months of the service. Gift codes expire twelve months after purchase if unredeemed, have no cash value, and are refundable within 14 days of purchase provided the code has not been redeemed. Referral rewards are additional service time, not money; they have no cash value, and we may withhold or reverse rewards where we reasonably believe the referral scheme has been abused.

8. Charitable donations

Where a donation pledge is displayed at the point of purchase, we will honour it as stated there. The pledge is a commitment made by us; it does not form part of the price or of the service supplied to you.

9. Intellectual property and attribution

The service, its content, its character and its name belong to Brewyon & Co Ltd or its licensors. Tide predictions contain ADMIRALTY® data © Crown copyright, used under licence from the UK Hydrographic Office. Weather and marine data are provided by Open-Meteo; bathing-water data by the Environment Agency under the Open Government Licence. You receive a personal, non-transferable, revocable right to use the service. You acquire no rights in the underlying data beyond personal use.

10. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law. Subject to that: we are not liable for decisions made in reliance on the information we provide (see section 2); we are not liable for unavailability of the service, including where caused by WhatsApp, our suppliers or your network; and our total liability to you in any 12-month period is limited to the amounts you paid us in that period.

11. Suspension, termination and changes

You may stop using the service at any time by cancelling your plan or sending STOP on WhatsApp. We may suspend or end your access for serious or repeated breach of these terms; if we do, we will refund any unused paid period unless the breach itself prevents us from providing the service. We may amend these terms from time to time. If a change materially affects you, we will notify you on WhatsApp at least 30 days before it takes effect, and you may cancel before it does.

12. General

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except that if you live in Scotland or Northern Ireland you retain the benefit of any mandatory consumer protections, and the right to bring proceedings, in your home nation. If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect. Complaints may be raised by email to josh@brewyon.com or by sending the word COMPLAINT on WhatsApp; we acknowledge complaints within 30 days.
